Habit 22 — Terms of Use

1 Acceptance of Terms

By downloading, installing, or using Habit 22 ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Adam Tansley / XXII AI ("we", "us", or "our").

2 Description of Service

Habit 22 is a personal habit tracking application that provides:

• Habit Tracking: Create and track daily habits with custom schedules
• Streaks: Monitor your consistency with current and best streak tracking
• Statistics: View trends, heatmaps, and insights about your habit performance
• Reminders: Set custom notification times for each habit

The App is designed for personal use and stores all data locally on your device.

3 Subscriptions & Payments

Free Tier

Habit 22 offers a free tier that includes up to 3 habits, 30 days of history, streak tracking, reminders, and calendar view.

Premium Subscription Plans

For access to the full feature set, Habit 22 offers premium subscriptions:

• Monthly: £1.99 per month
• Yearly: £14.99 per year (equivalent to £1.25/month, save 37%)

Premium features include up to 8 habits, full history access, advanced statistics, premium themes, and data export/import.

Billing

Subscriptions are billed through the Apple App Store. Payment will be charged to your App Store account at confirmation of purchase.

Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You can cancel your subscription at any time through your App Store account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the period you have paid for.

Refunds

Refund requests are handled by Apple according to their refund policy. We do not directly process refunds.

Free Tier After Cancellation

If your premium subscription expires, you retain access to the free tier features. Your existing habits and data remain intact, but features beyond the free tier limits will be locked until you resubscribe.

4 Your Content & Data

Ownership

You retain full ownership of all content you create within Habit 22, including your habits, completion logs, and any other data. We do not claim any ownership rights over your content.

Local Storage

All your content is stored locally on your device. We do not have access to your data and cannot retrieve it if lost. You are responsible for backing up your data using the in-app export feature.

Data Loss

We are not responsible for any loss of data due to device failure, app uninstallation, or any other cause. We strongly recommend regularly exporting your data using the backup feature.

5 Acceptable Use

You agree to use Habit 22 only for lawful purposes and in accordance with these Terms. You agree not to:

• Attempt to reverse engineer, decompile, or disassemble the App
• Attempt to bypass or circumvent subscription requirements
• Use the App in any way that violates applicable laws or regulations
• Distribute, sublicense, or transfer the App to any third party
• Use the App to infringe on the rights of others

6 Intellectual Property

The App, including its design, features, code, graphics, and branding, is owned by Adam Tansley / XXII AI and is protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

"Habit 22", the Habit 22 logo, and "XXII AI" are trademarks of Adam Tansley. You may not use these marks without prior written permission.

7 Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• That the App will be uninterrupted, error-free, or secure

We do not warrant that the App will meet your specific requirements or expectations. Habit 22 is a tool to assist with habit tracking and does not guarantee any particular health, wellness, or lifestyle outcomes.

8 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ADAM TANSLEY / XXII AI BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, goodwill, or other intangible losses
• Any damages resulting from your use or inability to use the App
• Any damages resulting from unauthorized access to your data

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

9 Termination

You may stop using the App at any time by uninstalling it from your device and cancelling any active subscription.

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or third parties
• Is harmful to us or our business interests

10 Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Posting a notice within the App
• Updating the "Last Updated" date at the top of these Terms

Your continued use of the App after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you should discontinue use of the App.

11 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
